Private messages between Labour Party ministers have revealed plans to oppose a recent Supreme Court decision that says people born male but identifying as female are not legally considered women.

Despite the government publicly accepting the ruling, leaked WhatsApp messages show some Labour ministers are upset and planning a private meeting to figure out how to respond. Culture Minister Chris Bryant and Home Office Minister Angela Eagle were among those criticizing the judgment, which defines “woman” strictly based on biological sex.

Angela Eagle said transgender people are likely feeling hurt by the ruling and urged colleagues to “organise.” Another MP, Chris Murray, supported holding a meeting as soon as possible.

The ruling was welcomed by Baroness Falkner, head of the Equality and Human Rights Commission (EHRC), who said services like changing rooms should be based on biological sex. She confirmed this also means transgender women can’t participate in women’s sports and warned the NHS must follow updated rules on single-sex spaces.

The ruling has sparked strong political reactions. Tory leader Kemi Badenoch accused Labour’s Equalities Minister Bridget Phillipson of making contradictory public statements and called for an investigation. Phillipson had previously supported allowing trans women with male anatomy into female-only spaces.

Shadow Minister Mims Davies criticized Labour for pretending to support the court decision in public while opposing it in private. She defended Baroness Falkner for standing up for women’s rights and urged the government to stick with the EHRC guidance.
