The Same Day He Was Released From Prison, Man Followed an 11-Year-Old Girl Into Her Home With His Trousers Undone Until the Unexpected Happened

A convicted sexual offender has been sent back to prison after following an 11-year-old girl into her home on the very same day he had been released from jail.

Mukisa Kubaya, 48, approached two young girls who were playing in a garden on July 23 this year. At the time, Kubaya was already under a sexual harm prevention order which banned him from having any direct or indirect contact with anyone under the age of 18.

Leeds Crown Court heard that Kubaya had been released from prison earlier that day after serving a sentence for breaching the same order. However, just hours after being freed, he found himself in trouble again.

Prosecutor Zanisha Herbert told the court that Kubaya, who has no fixed address, had taken cannabis after leaving his supported accommodation. He was said to be under the influence when the incident happened.

Between 8pm and 9pm, Kubaya was walking along a street with his trousers unfastened when he noticed two young girls playing outside a house. He approached them and asked if they could give him a glass of water.

One of the girls, aged 11, told Kubaya to remain outside while she went into the house to speak to her father. But instead of waiting in the garden as she had asked, Kubaya followed the child inside.

The girl’s father then saw Kubaya inside the property and noticed that his underwear was exposed. He immediately told Kubaya to leave the house, and Kubaya eventually went outside.

Concerned by what had happened, the father spoke to a neighbour and discovered that Kubaya had apparently approached the neighbour with a similar request. The two men then went to confront him.

Witnesses said Kubaya appeared to be under the influence at the time. Police were called and he was arrested later that same day.

During a police interview, Kubaya admitted that he had committed the offence. He later pleaded guilty in the lower court.

The court was told that Kubaya was subject to a sexual harm prevention order lasting until 2031. The order specifically prohibited him from making direct or indirect contact with children under the age of 18.

His lawyer, Sean Smith, referred to a pre-sentence report and told the court that Kubaya had already entered a guilty plea.

Judge Batty described the incident as a very serious breach, particularly because Kubaya had only just been released from prison and was still on licence.

The judge said Kubaya had checked into his supported accommodation after his release but later went out and took cannabis before approaching the children.

Addressing Kubaya directly, the judge said he had deliberately approached the 11-year-old girl and stressed the seriousness of his behaviour given his previous history and the restrictions placed upon him.

The judge also pointed out that the girl had specifically asked Kubaya to stay outside while she went to get her father, but he ignored her request and followed her into the house.

According to the judge, the incident did not develop any further because the girl’s father was inside the property and quickly intervened.

The judge told Kubaya that his decision to follow the child inside showed that he “wanted to get close” to her.

Kubaya was sentenced to two years in prison.
